VOP jsou ned\u00edlnou sou\u010d\u00e1st\u00ed v\u0161ech ujedn\u00e1n\u00ed mezi Ubytovatelem a Klientem. Potvrzen\u00edm Nab\u00eddky Ubytovatele, resp. rezervace Klienta (d\u00e1le jen \u201eRezervace\u201c), uzn\u00e1v\u00e1 Klient n\u00e1sleduj\u00edc\u00ed VOP za z\u00e1vazn\u00e9 pro v\u0161echna pln\u011bn\u00ed souvisej\u00edc\u00ed s p\u0159edm\u011btem VOP.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Objednat pobyt v Penzionu Maj\u00e1k Zv\u00edrotice lze pouze vypln\u011bn\u00edm a odesl\u00e1n\u00edm webov\u00e9ho formul\u00e1\u0159e, nebo telefonicky a v takov\u00e9m p\u0159\u00edpad\u011b je v\u0161ak objedn\u00e1vka pova\u017eov\u00e1na za p\u0159ijatou a\u017e po odesl\u00e1n\u00ed webov\u00e9ho formul\u00e1\u0159e. Rezervaci m\u016f\u017ee prov\u00e9st Klient pro sebe nebo ve prosp\u011bch t\u0159et\u00ed osoby. Rezervaci Ubytovatel potvrd\u00ed Klientovi po \u00fahrad\u011b ubytov\u00e1n\u00ed na e-mail, kter\u00fd je uveden v\u00a0rezervaci. Rezervace (Objedn\u00e1vka) mus\u00ed obsahovat:
\u2022 jm\u00e9no a p\u0159\u00edjmen\u00ed Klienta
\u2022 term\u00edn pobytu
\u2022 kontaktn\u00ed \u00fadaje Klienta: telefonn\u00ed \u010d\u00edslo, adresu trval\u00e9ho bydli\u0161t\u011b, e-mail
\u2022 zp\u016fsob \u00fahrady
\u2022 po\u010det objednan\u00fdch osob ve struktu\u0159e dosp\u011bl\u00e9 osoby x d\u011bti (u d\u011bt\u00ed v\u011bk)

Klient p\u0159i p\u0159\u00edjezdu zaplat\u00ed vratnou kauci 2.500 K\u010d za apartm\u00e1n. Cenu za ubytov\u00e1n\u00ed a slu\u017eby, je Klient povinen uhradit:<\/p>

  1. Platebn\u00ed kartou formou online platby p\u0159es platebn\u00ed br\u00e1na<\/a>\u00a0ComGate<\/li>
  2. platba bankovn\u00edm p\u0159evodem p\u0159es platebn\u00ed br\u00e1na<\/a>\u00a0ComGate<\/li>
  3. ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech po p\u0159edchoz\u00ed telefonick\u00e9 dohod\u011b v hotovosti k ruk\u00e1m Ubytovatele oproti p\u0159\u00edjmov\u00e9mu pokladn\u00edmu dokladu.<\/li><\/ol>

    Ceny jsou uvedeny v rezerva\u010dn\u00edm formul\u00e1\u0159i na str\u00e1nk\u00e1ch penzionu a je v nich zahrnut ubytovac\u00ed a l\u00e1ze\u0148sk\u00fd poplatek, spot\u0159eba energi\u00ed a \u00faklid. Online platby pro n\u00e1s zaji\u0161\u0165uje platebn\u00ed br\u00e1na<\/a>\u00a0ComGate. Poskytovatel slu\u017eby, spole\u010dnost ComGate Payments, a.s., je licencovan\u00e1 Platebn\u00ed instituce p\u016fsob\u00edc\u00ed pod dohledem \u010cesk\u00e9 n\u00e1rodn\u00ed banky. Platby prob\u00edhaj\u00edc\u00ed skrze platebn\u00ed br\u00e1nu jsou pln\u011b zabezpe\u010deny a ve\u0161ker\u00e9 informace jsou \u0161ifrov\u00e1ny.<\/p>

    4. Pr\u00e1va a povinnosti Klienta<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    K \u010derp\u00e1n\u00ed zaplacen\u00fdch slu\u017eeb oprav\u0148uje klienta potvrzen\u00e1 rezervace. Klient je povinen na t\u00e9to rezervaci p\u0159ekontrolovat spr\u00e1vnost \u00fadaj\u016f. P\u0159i zji\u0161t\u011bn\u00ed jak\u00e9koliv nesrovnalosti kontaktuje klient neprodlen\u011b penzion e-mailem nebo telefonicky. P\u0159i n\u00e1stupu se klient prok\u00e1\u017ee ob\u010dansk\u00fdm pr\u016fkazem, pasem nebo jin\u00fdm pr\u016fkazem toto\u017enosti. Po spln\u011bn\u00ed uveden\u00fdch formalit je klient ubytov\u00e1n a jsou mu poskytnuty dal\u0161\u00ed informace k pobytu \u010di k dal\u0161\u00edm objednan\u00fdm slu\u017eb\u00e1m. Klient m\u00e1 pr\u00e1vo u\u017e\u00edvat po dohodnutou dobu p\u0159id\u011blen\u00fd apartm\u00e1n. Apartm\u00e1n se p\u0159ed\u00e1v\u00e1 Klientovi v\u017edy od 16:00 \u2013 18:00 hodin, leda\u017ee se Ubytovatel s Klientem dohodnou jinak. Klient je povinen zach\u00e1zet s majetkem Ubytovatele \u0161etrn\u011b. Ka\u017edou zji\u0161t\u011bnou z\u00e1vadu nebo \u0161kodu na za\u0159\u00edzen\u00ed je Klient povinen neprodlen\u011b nahl\u00e1sit Ubytovateli. Klient je povinen udr\u017eovat po\u0159\u00e1dek a \u010distotu v apartm\u00e1nu a v\u0161ech dal\u0161\u00edch spole\u010dn\u00fdch prostor\u00e1ch ubytovac\u00edho za\u0159\u00edzen\u00ed. Klient je povinen dodr\u017eovat no\u010dn\u00ed klid v dob\u011b od 22:00 \u2013 7:00 hodin. Klient je povinen zabezpe\u010dit soukrom\u00e9 (vnesen\u00e9) v\u011bci tak, aby nemohlo doj\u00edt k jejich odcizen\u00ed. Ubytovatel tyto v\u011bci nepoji\u0161\u0165uje a vzhledem k charakteru ubytovac\u00edho za\u0159\u00edzen\u00ed a provozn\u00edm podm\u00ednk\u00e1m za tyto v\u011bci neru\u010d\u00ed.\u00a0 Klient m\u00e1 pr\u00e1vo reklamovat p\u0159\u00edpadn\u00e9 nedostatky poskytovan\u00fdch slu\u017eeb. Reklamaci je povinen uplatnit v\u010das, bez zbyte\u010dn\u00e9ho odkladu tak, aby mohla b\u00fdt sjedn\u00e1na n\u00e1prava, pokud mo\u017eno na m\u00edst\u011b sam\u00e9m. Bli\u017e\u0161\u00ed podm\u00ednky reklamace stanov\u00ed Reklama\u010dn\u00ed \u0159\u00e1d, kter\u00fd je ned\u00edlnou sou\u010d\u00e1st\u00ed VOP.\u00a0 Klient je povinen p\u0159i n\u00e1stupu do ubytovac\u00edho za\u0159\u00edzen\u00ed p\u0159evz\u00edt svazek kl\u00ed\u010d\u016f. Ztr\u00e1tu svazku kl\u00ed\u010d\u016f, nebo jeho \u010d\u00e1st\u00ed, je Klient povinen neprodlen\u011b bez zbyte\u010dn\u00e9ho odkladu ozn\u00e1mit Ubytovateli. Svazek kl\u00ed\u010d\u016f je majetkem ubytovatele, p\u0159i ztr\u00e1t\u011b je Klient povinen uhradit v\u00fddaje spojen\u00e9 s v\u00fdm\u011bnou vlo\u017eky, kl\u00ed\u010d\u016f apod., resp. dal\u0161\u00ed n\u00e1klady, kter\u00e9 bude Ubytovatel nucen vynalo\u017eit na odstran\u011bn\u00ed touto ztr\u00e1tou vyvolan\u00fdch n\u00e1sledk\u016f.<\/p>

    Klient odpov\u00edd\u00e1 za osoby, kter\u00e9 za n\u00edm p\u0159i\u0161ly na n\u00e1v\u0161t\u011bvu po celou dobu jejich pobytu v objektu, a je povinen je doprov\u00e1zet p\u0159i jejich pr\u016fchodu spole\u010dn\u00fdmi prostorami objektu. Pro n\u00e1v\u0161t\u011bvy Klienta plat\u00ed stejn\u00e9 povinnosti jako pro Klienta. Ubytovatel m\u00e1 pr\u00e1vo, podle vlastn\u00edho uv\u00e1\u017een\u00ed, neumo\u017enit vstup jin\u00e9 osob\u011b do objektu a nebo takovou osobu n\u00e1sledn\u011b z objektu vyk\u00e1zat.<\/p>

    Klient ru\u010d\u00ed a odpov\u00edd\u00e1 Ubytovateli za jakoukoliv \u0161kodu, kterou zp\u016fsob\u00ed on nebo jeho host nebo jin\u00e9 osoby, kter\u00e9 s v\u011bdom\u00edm nebo podle v\u016fle Klienta vyu\u017e\u00edvaj\u00ed slu\u017eeb Ubytovatele. Klient je povinen p\u0159edat apartm\u00e1n Ubytovateli ve stavu v jak\u00e9m jej p\u0159evzal.<\/p>

    V p\u0159\u00edpad\u011b, \u017ee Klient nep\u0159ed\u00e1 Ubytovateli apartm\u00e1n ve stavu v\u00a0jak\u00e9m jej p\u0159evzal, je Ubytovatel opr\u00e1vn\u011bn vym\u011b\u0159it Klientovi pen\u011b\u017en\u00ed pokutu do v\u00fd\u0161e n\u00e1klad\u016f spojen\u00fdch s uveden\u00edm apartm\u00e1nu do p\u016fvodn\u00edho stavu. Klient je povinen uvolnit apartm\u00e1n v den odjezdu do 10:00 hodin, pokud se s Ubytovatelem nedohodl jinak. V p\u0159\u00edpad\u011b, \u017ee Klient neuvoln\u00ed apartm\u00e1n ve stanoven\u00e9m \u010dase, je Ubytovatel opr\u00e1vn\u011bn\u00fd Klientovi \u00fa\u010dtovat dal\u0161\u00ed pobytov\u00fd den nebo osobn\u00ed zavazadla Klienta vyst\u011bhovat a zajistit, aby nedo\u0161lo k omezen\u00ed pr\u00e1v dal\u0161\u00edch Klient\u016f.<\/p>

    Klientovi je zak\u00e1z\u00e1no:<\/strong><\/p>

    • umo\u017enit vstup, pobyt a p\u0159esp\u00e1n\u00ed v ubytovac\u00edm za\u0159\u00edzen\u00ed t\u0159et\u00edm osob\u00e1m, p\u016fj\u010dovat kl\u00ed\u010de od ubytovac\u00edho za\u0159\u00edzen\u00ed t\u0159et\u00edm osob\u00e1m,<\/li>
    • p\u0159emis\u0165ovat n\u00e1bytek a jin\u00e9 vybaven\u00ed do jin\u00fdch pokoj\u016f nebo prostor bez souhlasu ubytovatele,<\/li>
    • kou\u0159it v prostor\u00e1ch penzionu<\/li>
    • vn\u00e1\u0161et do ubytovac\u00edho za\u0159\u00edzen\u00ed a m\u00edt v u\u017e\u00edvan\u00e9m prostoru resp. pokoji: ho\u0159lav\u00e9, v\u00fdbu\u0161n\u00e9 a z\u00e1paln\u00e9 l\u00e1tky, zbran\u011b, drogy (v\u010d. marihuany), neskladn\u00e9 p\u0159edm\u011bty, plynov\u00e9 spot\u0159ebi\u010de, elektrick\u00e9 p\u0159\u00edmotopn\u00e9 spot\u0159ebi\u010de, elektrick\u00e9 varn\u00e9 plot\u00fdnky apod.,<\/li>
    • zne\u010di\u0161\u0165ovat \u010di jinak znehodnocovat spole\u010dn\u00e9 prostory a okol\u00ed ubytovac\u00edho za\u0159\u00edzen\u00ed.<\/li><\/ul>

      Podm\u00ednkou pro pobyt v ubytovac\u00edm za\u0159\u00edzen\u00ed Ubytovatele je zejm\u00e9na dodr\u017eov\u00e1n\u00ed z\u00e1kladn\u00edch pravidel spole\u010densk\u00e9ho sou\u017eit\u00ed, tolerance a vz\u00e1jemn\u00e9ho respektu ve smyslu ob\u010dansk\u00e9ho z\u00e1kon\u00edku, dodr\u017eov\u00e1n\u00ed no\u010dn\u00edho klidu, dodr\u017eov\u00e1n\u00ed po\u0159\u00e1dku a \u010distoty ve v\u0161ech prostor\u00e1ch uvnit\u0159 objektu a v jeho bezprost\u0159edn\u00edm okol\u00ed. Za poru\u0161en\u00ed povinnost\u00ed uveden\u00fdch t\u011bchto VOP je Ubytovatel opr\u00e1vn\u011bn vym\u011b\u0159it Klientovi pen\u011b\u017en\u00ed pokutu do v\u00fd\u0161e 2 000 K\u010d. Pr\u00e1vo na ubytov\u00e1n\u00ed v ubytovac\u00edm za\u0159\u00edzen\u00ed zanik\u00e1 k posledn\u00edmu dni ubytov\u00e1n\u00ed uveden\u00e9mu v potvrzen\u00ed objedn\u00e1vky ubytov\u00e1n\u00ed Ubytovatelem. Pr\u00e1vo na ubytov\u00e1n\u00ed zanik\u00e1 okam\u017eit\u011b, jestli\u017ee Klient poru\u0161\u00ed tyto VOP nebo hrub\u00fdm zp\u016fsobem poru\u0161il pravidla spole\u010densk\u00e9ho sou\u017eit\u00ed dle dohody. V takov\u00e9m p\u0159\u00edpad\u011b m\u016f\u017ee Ubytovatel ukon\u010dit ubytovac\u00ed slu\u017eby i bez n\u00e1rok\u016f na vr\u00e1cen\u00ed zb\u00fdvaj\u00edc\u00ed \u010d\u00e1stky za ubytov\u00e1n\u00ed. Pr\u00e1vo na ubytov\u00e1n\u00ed v ubytovac\u00edm za\u0159\u00edzen\u00ed zanik\u00e1 posledn\u00edm dnem do doby, na kterou jsou ubytovac\u00ed slu\u017eby uhrazeny. Klient je povinen opustit apartm\u00e1n a p\u0159edat Ubytovateli jej v\u010detn\u011b v\u0161ech n\u00e1le\u017eitost\u00ed do 10:00 hodin. Nedodr\u017een\u00ed t\u00e9to povinnosti podl\u00e9h\u00e1 pokut\u011b 1.000,-K\u010d. V p\u0159\u00edpad\u011b skon\u010den\u00ed ubytov\u00e1n\u00ed nem\u00e1 Klient n\u00e1rok na p\u0159id\u011blen\u00ed n\u00e1hradn\u00edho ubytov\u00e1n\u00ed. V p\u0159\u00edpad\u011b, \u017ee Klient nevyklid\u00ed ubytovac\u00ed prostor ve smyslu p\u0159edchoz\u00edho odstavce, je Ubytovatel opr\u00e1vn\u011bn majetek Klienta na n\u00e1klady Klienta vyst\u011bhovat. Ubytovatel v t\u011bchto p\u0159\u00edpadech schra\u0148uje majetek Klienta po dobu 2 t\u00fddn\u016f ve sv\u00fdch prostor\u00e1ch a po t\u00e9to dob\u011b jej m\u016f\u017ee zlikvidovat a nebo pro odvoz a schra\u0148ov\u00e1n\u00ed v\u011bc\u00ed Klienta najme firmu. Klient pro takov\u00fd p\u0159\u00edpad zmoc\u0148uje Ubytovatele, aby jeho jm\u00e9nem, jako slo\u017eitel na toto uzav\u0159el smlouvu s vybran\u00fdm schovatelem, a to za b\u011b\u017en\u00fdch obchodn\u00edch podm\u00ednek.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      5. Pr\u00e1va a povinnosti Ubytovatele<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t\t\t\t\t

      Ubytovatel si vyhrazuje pr\u00e1vo ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech poskytnout Klientovi jin\u00e9 ubytov\u00e1n\u00ed, ne\u017e bylo p\u016fvodn\u011b dohodnut\u00e9, pokud se nijak podstatn\u011b neli\u0161\u00ed od potvrzen\u00e9 objedn\u00e1vky. Ubytovateli p\u0159\u00edslu\u0161\u00ed pr\u00e1vo sv\u00e9 slu\u017eby kdykoliv vy\u00fa\u010dtovat.<\/p>

      Ubytovatel m\u016f\u017ee prodlou\u017eit pobyt Klientovi jen v p\u0159\u00edpad\u011b, \u017ee m\u00e1 Ubytovatel k dispozici volnou kapacitu.<\/p>

      V p\u0159\u00edpad\u011b, \u017ee Klient ukon\u010d\u00ed sv\u016fj pobyt d\u0159\u00edve, ne\u017e bylo sjedn\u00e1no v potvrzen\u00ed rezervace, Ubytovatel m\u00e1 pr\u00e1vo \u00fa\u010dtovat Klientovi \u010d\u00e1stku za cel\u00fd pobyt v\u010detn\u011b slu\u017eeb. Ubytovatel je opr\u00e1vn\u011bn ukon\u010dit poskytov\u00e1n\u00ed slu\u017eeb Klientovi a odstoupit od smlouvy s okam\u017eitou platnost\u00ed a bez n\u00e1roku Klienta na vr\u00e1cen\u00ed pen\u011bz, kdy\u017e:<\/p>

      • Klient \u00famysln\u011b nebo nedbale po\u0161kozuje majetek Ubytovatele, \u010di jeho chov\u00e1n\u00ed je v rozporu se z\u00e1sadami slu\u0161n\u00e9ho spole\u010densk\u00e9ho chov\u00e1n\u00ed, mor\u00e1lkou nebo obt\u011b\u017euje sv\u00fdm chov\u00e1n\u00edm t\u0159et\u00ed osoby,<\/li>
      • zdravotn\u00ed stav Klienta ohro\u017euje zdrav\u00ed t\u0159et\u00edch osob a person\u00e1lu,<\/li>
      • z\u00a0d\u016fvodu z\u00e1sahu vy\u0161\u0161\u00ed moci.<\/li><\/ul>

        \u00a0<\/p>

        P\u0159edan\u00e9 osobn\u00ed \u00fadaje Klienta uveden\u00e9 v objedn\u00e1vce pobytu je Ubytovatel opr\u00e1vn\u011bn pou\u017e\u00edt pouze pro uzav\u00edran\u00fd smluvn\u00ed vztah mezi Ubytovatelem a Klientem.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        6. Storno podm\u00ednky a nedojezd<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        Pokud Klient odstoup\u00ed od uzav\u0159en\u00e9 smlouvy, je povinen hradit provozovateli n\u00ed\u017ee uveden\u00e9 storno poplatky z celkov\u00e9 ceny pobytu.<\/p>

        Storno poplatky \u010din\u00ed:<\/p>

        • 0 % z ceny pobytu, dojde-li k odstoupen\u00ed od smlouvy do 7 dn\u00ed p\u0159ed smluven\u00fdm datem zah\u00e1jen\u00ed pobytu,<\/li>
        • 50 % z ceny pobytu, dojde-li k odstoupen\u00ed od smlouvy do 7 \u2013 3 dny p\u0159ed smluven\u00fdm datem zah\u00e1jen\u00ed pobytu,<\/li>
        • 100% z ceny pobytu, dojde-li k odstoupen\u00ed od smlouvy m\u00e9n\u011b jak 3 dny p\u0159ed smluven\u00fdm datem zah\u00e1jen\u00ed pobytu.<\/li><\/ul>

          Pokud klient nenastoup\u00ed v rezervovan\u00e9m term\u00ednu ubytov\u00e1n\u00ed a ani svou rezervaci p\u00edsemn\u011b nezru\u0161\u00ed, je rezervace stornov\u00e1na a klientovi je \u00fa\u010dtov\u00e1no 100% z ceny pobytu.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

          Tyto VOP jsou ned\u00edlnou sou\u010d\u00e1st\u00ed objedn\u00e1vky ubytov\u00e1n\u00ed. Pro skupinov\u00e9 pobyty mohou b\u00fdt sjedn\u00e1ny jin\u00e9 podm\u00ednky rezervace. Pokud Klient tyto podm\u00ednky neobdr\u017e\u00ed, je opr\u00e1vn\u011bn si je vy\u017e\u00e1dat u Ubytovatele. Klient m\u00e1 povinnost se s podm\u00ednkami sezn\u00e1mit p\u0159ed uskute\u010dn\u011bn\u00edm rezervace a Ubytovatel k tomu zaji\u0161\u0165uje podm\u00ednky prost\u0159ednictv\u00edm sv\u00e9 webov\u00e9 prezentace, rezerva\u010dn\u00edch formul\u00e1\u0159\u016f, e-mailov\u00e9ho vyj\u00e1d\u0159en\u00ed k p\u0159edb\u011b\u017en\u00e9 rezervaci \u010di na vy\u017e\u00e1d\u00e1n\u00ed. V\u0161eobecn\u00e9 obchodn\u00ed podm\u00ednky vstupuj\u00ed v platnost dne 1. 4. 2020. Zm\u011bny a dopl\u0148ky t\u011bchto podm\u00ednek mohou b\u00fdt individu\u00e1ln\u011b upraveny mezi Ubytovatelem a Klientem v\u00fdlu\u010dn\u011b p\u00edsemnou formou.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
